Our position

Child detention violates child rights.

Immigration detention of children always contravenes the principle of the best interests of the child.

The profound and negative impact of detention on child health, development and well-being has been demonstrated repeatedly, even for a short period of time and when detention takes place in a relatively humane environment.

...treated as children
Children are, first and foremost, children and should be treated in full accordance with international law concerning child rights.

Liberty is a fundamental human right. Children should never be detained solely based upon their or their parent’s or guardian’s immigration status.

The best interests of the child must be a primary consideration in any action that a State might take in relation to a child.

We do not want children to be detained in our country, solely on the basis of their or their parent’s or guardian’s migration status. We want all children to be treated as children, to be free, to be looked after and protected, and to enjoy the same rights.

What do experts say?

The detention of a child because of their or their parent’s migration status constitutes a child rights violation and always contravenes the principle of the best interests of the child.

UN Committee on the Rights of the Child UNICEF urges States to recall that a child is first and foremost a child and that all children—regardless of migration status—are entitled to the full set of rights as recognised in the Convention on the Rights of the Child (CRC).

UNICEF Belgium UNHCR’s position is that children should not be detained for immigration related purposes, irrespective of their legal/migratory status or that of their parents, and detention is never in their best interests.

UN Refugee Agency I called on the Belgian authorities to refrain from resuming the practice of detaining migrant families with children.

Nils MuižnieksCommissioner for Human Rights, Council of Europe Detention is never ever in the best interest of a child. Freedom should be the default position, as it is for citizens and regular residents.

Why does the government lock up children and their families?

The Immigration Office puts families behind bars because these families don't have a residence permit in Belgium. Have they received an order to leave the country, or sometimes more than one, some of these families still decide to stay in Belgium. Their children go to school, and their parents often work. The Belgian government feels that the only way to make these families leave the country as by locking them up, and force them to depart. Each family's individual situation, their integration in Belgium, and their reintegration possibilities in their home country are not taken into account.
