Life,Times and Tales of East African seniors:The biographic tales of William BahiireBaranyanka

His name is William Bahiire Balanyanka, a resident of Kibalangulo,Mityana. He was born  to the late Fabiano Bahiire Balanyanka in 1922 at Kiziba-Mamba. His father settled at Kiziba as a result of migration from the southern territories.His wife was the late Josephine Kadogwe Barakanfitiye Mukombanya who passed on in 2003.His child associates were Maria Tuyaga(Kiziba) and Ruhitamo Mulengera ( Maddu), for they all grew up in the house of Ruhitamo Mulengera , his memorable step father. He descends from  Dokiye Ndiho and Bugemikyambi,his respective grand fathers. He belonged to Abasinga clan but due to hard immigrant realities his father converted to Ente clan of the Ganda tradition. In view of these realities, William Baranyanka is also known as Kityamuweesi, a latter name given to him by his father. When his father died , in 1947,he joined Kawolo/Lugazi sugar plantation as a casual employee. He later  relocated to Bukoba-Kyagwe and thereafter  Ndesse and Namaliri and finally Villa Maria in Masaka. In 1952,with the help of one Mukiibi,a fish trader (Rip), he sold his father`s piece of land and settled at Kibalangulo-Bulera. With Josephine Kadogwe, they begot Nabakooza Aida,1954 (Kibalangulo), Sekate Joseph ,1958 ( Kibalangulo), Kakooza Godfrey ,1961 (Kibalangulo), Kimbowa Isack ,1969 (Nayise), Kabona Cosmas,1971 (Kabowa-Kampala), Serugo Kaloori Galiba Mawugulu,1974 (Rip), Kasumba Edward Friday, 1976 (Rip) and  Ssekyanzi Paul ,1979 ( Ganda-Wakiso).   .*imageschildren)*                                                                                                                                                                                                                                         Nabakooza Nabakooza Aida begot Nassande Prossy (Kajjansi-Entebbe) and others. The family celebrated the  marriage in holy matrimony of Josephine and William Baranyanka  on 20th May, 1978. The church ceremony was performed by father Mukajjanga and witnessed by Mary and Mikayiri Mitunu of Sirobera singo.

On 27th January 2001,the family celebrated the Makerere University award of a Bachelor’s degree to one of its members. The function at Makerere, was attended by Josephine Kadowe Barakanfitiye and others.The celebrations started from Makerere`s Michelle Hall (the celebrant`s residence) to Kibalangulo (his father`s home village).

On 25th February,2008, the family celebrated the award of Graduate Diploma in Education from Makerere University to one of its members.In attendance were William Baranyanka,Ssekyanzi Paul, Josephine and Proscovia.

The family takes special considerations of the carrier achievements of some of its family members. Any sacrifice to the community is a sacrifice to the family.The family stands high when such sacrifices are made.                                                                    

The family on various occasions, and by way of marriage, has welcomed new members into the family.The following images form part of the pride of the family.

The family takes keen interest in any bit of educational endeavors and achievements of its members. We do congratulate all those who have exhibited any slightest step towards increasing their knowledge levels.

The family on all occasions,has participated in national programs geared towards the promotion of social,economic and cultural well-being of the people and encourages all to do the same at all times.

EARLY HISTORY:                                                                                                                                                                   QUEEN MPUNIKIYE , WILLIAM BARANYANKA , MARIA TUYAGA RUJJIRI , ANDEREYA BACHANAMU(NDEMEYE) AND  MULENGERA.

Queen Mpunikiye was the daughter of Muzira Mbaba (mr). Muzira Mbaba was a blood brother of Muyombana. Muyombana was the father of Batambala. Mpunikiye`s other known relative was Matama, who was her niece.

Miss Mpunikiye got married to Musananiye Kalemeera and begot Ndemeye Kitaramuka and  Maria Tuyaga. Mpunikiye then got married to Bahiire  and and begot William Balanyanka. Mpunikiye finally got married to Ruhitamo and begot  Mirindi (miss). Ruhitamo produced two children; Mirindi and Mulengera. So the children of Mpunikiye in a row were Ndemeye, Maria Tuyaga, William Balanyanka, Mirindi and Mulengera.Meru Bahiire,by another wife, begot Kazolya Meru. Bahiire was a blood brother of Gubente. Gubente was the father of Ruhagama(Kabukiira-Ndekuyamukungu). Ruhagama begot Nassazi (read as Nassaasi) and Ruth Musisi Namuwenda( Magogo-Mpigi). Ruth begets children. Queen Mpunikiye`s nephew ,Segahejje (son of Muyombana) , begot Emanuel Barisihira (Maddu-Gomba). Emanuel Barisihira begot Nikodemu Ntahondi (Maddu-Gomba). THE TRUST: The following shall constitute the Trust declaration , as amended from time to time.

ARTICLE 1

1.1 NAME: The trust hereby established by the “proprietor” above named is under the style and name of COSMAKA GRAMMAR SCHOOL REVOCABLE LIVING TRUST,a revocable trust that will become irrevocable after his death. The name COSMAKA is derived from two words COSMAS for COSMA… and KABONA for KA. COSMA-KA is a shorted word from COSMAS KABONA,the name of the proprietor.

1.2  NATURE OF THE TRUST: Cosmaka Junior School is a privately owned and managed primary school situated at Kibalangulo village,Kalangaalo sub-county,Mityana district.The Trust is an educational entity intended to provide quality and affordable education to the general public.

ARTICLE 2

2.1 DECLARATION OF TRUST: KABONA COSMAS, called the grantor, declares that he has transferred and delivered to the trustee all his interest in the property described here-under as; One acre of land, with developments comprising of a five classroom block building, a six stanza toilet, a one residential house, clear compound with trees, flowers and a temporary fence. All of that property is called the trust property. The trustee hereby acknowledges receipt of the trust property and agrees to hold the trust property in trust, according to this Declaration of Trust. The grantor may add property to the trust.

2.2 REGISTRATION OF TRUST PROPERTY: The property of the trust shall be registered in the names of the Grantor, during his lifetime, and thereafter be transferred into the names of the successor Managing trustee and any three other successor trustees of this trust.

2.3 GRANTOR`S RIGHT TO HOMESTEAD: If the grantors principal residence is held on the trust land, the grantor has the right to possess and occupy it for life, rent-free and without charge except for maintenance and related costs and expenses. This right extends to his children,grand children and great grand children.

2.4 OBJECTIVES OF THE TRUST : The trust intends to widen the scope of community life through provision of quality and affordable education. Its objectives shall be any or all of the following:
(a) To run a primary school institution at Kibangulo,Mityana,Uganda
(b) To increase school attendance by establishing this school near the target community
(c) To give professional education to children in the community of Kibalangulo and the general public.
(d ) To conduct primary school learning based on the curriculum that is consistent with the National curriculum development center of Uganda
(e) To employ the resources arising therefrom to provide an education that is consistent with the cultural values, ability and personality of the learners .
(f) To provide an environment conducive to holistic learning.

2.5 BENEFICIARIES OF THE TRUST : The trust shall benefit the Grantor ,his family, trustees and all humanity without discrimination.

2.6 SOURCE OF TRUST FUNDS: Any of the following means shall constitute the sources of funds for the trust.                                                                                                          (a) The funding of all the pioneer establishments as described in this instrument was done by the Grantor from his other income sources.                                                  (b) The education in the school shall be provided against a fee or fees.                        (c) The Managing trustee may fund-raise from friends and well-wishers.                        (d) The Grantor of this trust may continue to contribute to the trust from his other sources of income subject to his earnings

ARTICLE 3

3.1 MANAGEMENT OF THE TRUST: The business and affairs of COSMAKA GRAMMAR SCHOOL shall be managed by the trustee who shall be the top most custodian of the trust.The Trustee has designated himself as the Managing Trustee and the Chief Executive Officer of this trust. The Trustee shall direct, manage and control the business of the trust to the best of his ability and shall have full and complete authority ,power and discretion to make any and all decisions and to do any and all things which he deems to be reasonably required in light of his business objectives. Consistent with this responsibility, all concerns expressed from any organs, parents and other community members to any officer and staff of the trust shall be referred to the Managing trustee for review and action. No organ, staff,parent or community member shall be mandated nor expected to perform managerial or administrative duties that belong to the Managing trustee.

3.2 INCAPABILITY OF THE MANAGING TRUSTEE DUE TO DEATH OR SICKNESS: When the Managing Trustee is unable to manage the School Trust due to sickness or death, his responsibilities shall be taken over by (i) his legal heir,as Managing Trustee (ii) all his children,as successor Trustees (iii) his brother Ssekyanzi Paul,as successor trustee (iv) his brother Kimbowa Isack, as successor Trustee (v) his brother Kakooza Godfrey,as successor Trustee (vii) his sister Nabakooza Aida,as successor Trustee (viii) his brother Ssekate Joseph,as successor Trustees (ix) his brother Edward Kasumba Friday,as successor Trustee.The collective name for the Successor Managing trustee and all other successor Trustees shall be Board of Trustees. Consistent with the fact that the Managing trustee is the Chief Executive officer and the topmost custodian of the trust, all concerns expressed from any organs, parents and other community members to any successor Trustee, will be referred to the successor Managing trustee for review and action.

3.3 When the successor Managing trustee is unable to manage the school trust due to sickness or death,his legal heir shall take over his responsibilities as successor managing trustee.Such a successor Managing trustee shall have to be a paternal relative of the founder trustee in blood, clan and African family lineage. Such a hereditary process shall remain in place for all future managing trustees. Any prospective successor managing trustee unwilling to take over his responsibilities when required to do so shall have his responsibilities taken over by his child,brother or brother`s child with similar specified qualities.

3.4 When any of the reigning successor trustee becomes incapacitated by sickness or death, his or her legal heir, or any of his or her children shall take over his or her responsibilities as successor trustee. Such a successor trustee shall have to be a paternal relative of the founder trustee in blood, clan and African family lineage. Such a hereditary process shall remain in place for all future successor trustees. Any prospective or successor trustee unwilling to take over his responsibilities when required to do so shall have his responsibilities taken over by his child,brother or his brother`s child of similar specified qualities.

3.5 Where a successor trustee is designated posthumous or becomes incapacitated during the lifetime of the founder trustee,and there arises any roles to be played by such prospective trustee,his responsibilities shall be taken over by his legal heir or any of his children. Such a heir or a child shall be deemed the prospective successor trustee of the school trustee.The trustee succession criteria described of other prospective trustees shall equally apply to this prospective successor trustee.Any prospective or successor trustee unwilling to take over his responsibilities when required to do so shall have his responsibilities taken over by his child,brother or his brother`s child of similar specified qualities.

3.6  MEETINGS OF THE BOARD OF TRUSTEES
Where the context so admits and allows,there shall be Board of Trustee Meetings, all of which called by the Managing Trustee and attend by trustees only.The managing trustee shall chair all such meetings. The meetings shall not be so regular. The ordinary Meetings of the Board of Trustees shall not be more than two in a year. The Managing trustee shall call a special meeting at his own will or after a petition by any three successor trustees whenever need arises. The quorum shall be established by the presence of 80% of the members. Decisions shall be deemed to have been taken when a vote taken, is won by a simple majority of the members present,who constitute a quorum of 80 %.

3.7 MANAGEMENT FEE FOR MANAGING TRUSTEE: The Managing trustee shall be entitled to allowances for the services rendered to the trust commensurate with the value of such services.

3.8 MANAGEMENT FEE FOR SUCCESSOR TRUSTEES: All successor trustees shall be entitled to compensation for the services rendered to the trust commensurate with the value of such services.

ARTICLE 4

PROJECT PATRON; TEACHING STAFF; AND NON-TEACHING STAFF: The school trust shall have a Patron, teaching and non-teaching staff, all of whom appointed by the managing trustee on such terms and conditions as contained in the provisions of this trust deed and their letters of appointment. Consistent with the fact that the Managing trustee is the Chief Executive officer and the topmost custodian of the trust, all concerns expressed from any organs, parents and other community members to the patron, teaching and non-teaching staff, shall be referred to the Managing trustee for review and action.

ARTICLE 5

ORGANS OF THE TRUST: The Board of trustees and the Board of Governors shall be the only recognized administrative organs of the trust.

5.1 BOARD OF TRUSTEES: The successor Managing trustee and all successor trustees of this trust,shall collectively be referred to as the Board of trustees. The Board of trustees,during its time, shall be the topmost custodian organ of the school trust. The Board of trustees shall not be in existence during the lifetime of the Grantor and pioneer managing trustee.

5.2 GOVERNING BOARD: There shall be a Governing Board,comprised of The Managing trustee as chairman,the Patron as vice chairman, all prospective or successor trustees as members, the headmaster as secretary, the deputy headmasters as members, one staff representative as member and one Parent representative as member, all of whom appointed by the Managing trustee in accordance with the provisions of this Trust Deed and on such terms and conditions as contained on the application and appointment forms. The collective name for the Governing Board Membership shall be Board of Governors. Consistent with the fact that the Managing trustee is the Chief Executive officer and the topmost custodian of the trust, all concerns expressed from any organs, parents and other community members to any Governing Board member, shall be referred to the Managing trustee for review and action.

5.3 APPOINTMENT OF GOVERNING BOARD MEMBERS: The Managing Trustee shall hold the membership of the Governing Board throughout the time he is a Managing Trustee of this trust .The prospective or successor Trustees shall hold membership of the Governing Board throughout the time they are prospective or successor trustees of this trust.The Pioneer Project patron shall hold membership of the Governing Board throughout his lifetime and thereafter the most senior successor trustee in age shall become the project patron and vice chairman of the Governing Board. The headteacher and deputy headteachers shall be appointed as members of the Governing Board.The headteacher and deputy headteachers shall hold membership of the Governing Board for only that time they are holding those positions of headteacher and deputy headteacher of the school trust.The staff representative shall be appointed from the staff of the school trust.The staff representative shall not hold membership of the Governing Board for more than one year. The staff representative may be re-appointed if the Managing trustee finds it appropriate.The Parent representative shall be appointed from the current parents of the school and shall not hold membership of the Governing Board for more than one year. The Parent representative may be re-appointed if the Managing trustee finds it appropriate. Consistent with the fact that the Managing trustee is the Chief Executive officer and the topmost custodian of the trust, all concerns expressed from any organs, parents and other community members to any officer and staff of the trust will be referred to the Managing trustee for review and action.

5.4 INAUGURATION OF THE GOVERNING BOARD: The Managing trustee shall welcome the appointed Governing Board members by having them recite and sign an oath of allegiance to the school trust.

5.5 BOARD OF GOVERNORS ALLOWANCES: Members of the Board of Governors shall be entitled to sitting allowances for each Board Meeting they attend. A board meeting whose business continues into another successive day or days shall be treated as one for purposes of this allowance.

5.6 MEETINGS OF THE BOARD OF GOVERNORS
The Governing Board shall have one Ordinary meeting in a year called and chaired by the Managing trustee. The Managing trustee shall call a special meeting at his own will or after a petition by any three Governing Board members whenever need arises.The quorum shall be established by the presence of 80% of the members. Decisions shall be deemed to have been taken when a vote taken, is won by a simple majority of the members present,who constitute a quorum of 80 %.

5.7 MEETINGS OF THE TEACHING STAFF
The Managing trustee, shall delegate the headmaster to hold teaching staff meetings. Such meetings shall focus on the administration of learning in the school trust. The considerations or resolutions of the teachers meetings shall be forwarded without being requested for to the Managing trustee. The matters there-arising may be presented to the Governing Board if necessary for further consideration.

5.8 STAFF-PARENTS MEETINGS
The Managing trustee shall delegate the headmaster to hold teacher-parents meetings whenever required at such terms and conditions as he may determine from time to time.

ARTICLE 6

6.1 BOOKS OF ACCOUNTS: The Managing trust shall maintain complete and accurate Books of Account of the Trust affairs at the trust`s principal place of business or his preferred location.

6.2 HOLDING OF TRUST FUNDS: The Managing trustee shall hold in trust all money, securities and other property and apply it in such a manner as he shall determine for the benefit of the trust and the advancement of education in the School trust.

6.3 APPLICATION OF NET MONEY : If at any time the Managing trustee in his opinion feels that he has fulfilled the requirements of the Trust, the Net Money shall be paid to or used for the benefit of the grantor, the managing trustee, or successor trustees where applicable. Income to the grantor shall be paid atleat annually. Income accruing or paid to the Grantor`s personal accounts shall be deemed to have been paid to the grantor and shall be held by him for the benefit of himself and any other person, group of persons or organ of his wish.

6.4 TRUST BANK ACCOUNT: The Managing trustee shall operate a bank account for the trust where he is the sole signatory during his life time and thereafter,the Successor Managing trustee shall be the signatory.

ARTICLE 7

7.1  USE OF TRUST PROPERTY : The Managing trustee shall control the occupation and use of the Trust Property during such time or times as the Trust Property shall not be in use or required for the purposes of the School and (without prejudice to the generality of the above provisions) may use the Trust Property or allow it to be used for promoting ,aiding or furthering in any manner the educational or other community work in the area on such terms and conditions as he, from time to time, think fit.

7.2 APPLICATION OF TRUST PROPERTY : The Managing trustee may sell, mortgage lease or otherwise dispose of the Trust property or any part of it and any other property held for the purposes of this deed in any manner and apply the money in paying and discharging all encumbrances, liabilities and responsibilities contracted or occasioned in the execution of the duties of this trust for the benefit of the trust and the advancement of education in the school trust .

ARTICLE 8  TRUST AWARDS : The Managing trustee,mindful of the available financial resources,may give partial or full school fees exception to certain categories of learners for a particular period of academic period, under the following considerations;
(a) Needs-based Bursaries: Where some learners are enrolled with school fees exemption ,aware that, without such school fees assistance, such children would otherwise not be able to access Cosmaka Junior School Education services.
(b) Excellence-based Bursaries: Where talented learners making reasonable contributions in academics,music,dance,drama and sports are considered for partial or full school fees exemptions.
(c) Hardship-based Bursaries: Where learners whose parents` financial circumstances drastically change whilst the child is already in school are considered for partial or full school fees exemption.
(d) Local community-based Bursaries:Where children of parents who have been residents of Kibalangulo (the location of the trust) for more than twenty years by the time of the establishment of this trust may be considered for partial or full school fees exemption if they show need.
(e) Trustee family-based Bursaries: Where immediate or extended family members of the trustees may be considered for partial or full school fees exemption.

ARTICLE 9 SUPPORT SCHEMES: Friendly categories of the community shall be encouraged by the Managing trustee to love, advise and trust the school trust.
(a) House of Cosmaka: The grantor and his family, both immediate and extended, shall morale boost the school trust under the banner of “House of Cosmaka Junior School”
(b) Friends of Cosmaka: All manner of observable enthusiasts of the school trust shall be encouraged to continue doing so under the banner of “ Friends of Cosmaka Junior school”
(c) Association of Old students: All former students of the school trust shall be deemed to have informally associated into “ The Old Students of Cosmaka Junior School” with a view to morale boost their former school.
(d) Parents Association: All current and former parents of the School Trust shall be deemed to have informally associated into “ The Parents association of Cosmaka Junior School” with a view to keeping high the spirit of Cosmaka Junior school.
(e) Community of Cosmaka: The House of Cosmaka, Friends of Cosmaka, Old Students of Cosmaka ,Parents of Cosmaka and the Students of Cosmaka Junior school, shall all be collectively referred to as “ The Community of Cosmaka Junior school” for support and mobilization purposes.

ARTICLE 10

14 INTERPRETATION The clause headings do not form part of this deed and shall not be taken into account in its interaction or interpretation.

ARTICLE 11

Severability of Clauses
If any provision of this Declaration of Trust is ruled unenforceable, the remaining provisions shall stay in effect.

ARTICLE 12

AMENDMENT OR REVOCATION BY OTHER PERSON
The power to revoke or amend this trust is personal to the grantor. No other person shall do it on behalf of the grantor, unless the grantor specifically grants a power to revoke or amend this trust in a Durable Power of Attorney. This Trust Deed will become irrevocable upon the death of the Grantor and Founder trustee.

ARTICLE 13

DISSOLUTION:
In the event of dissolution of the Trust, the entire Trust funds shall be realized
and first be used for payment of liabilities of the Trust. The assets left if any, shall be disbursed to the grantor or, in case of the Grantor absence due to death, distributed in any manner, to his children, brothers and grand children only.

2.1 Employer: Your employer is Cosmaka Grammar school. Cosmaka Grammar school is a privately owned and managed institution. It is located at Kibalangulo in Mityana district. The proprietor of Cosmaka Grammar school is also the Chief executive Officer of this institution ( Which role shall extend to all his line successors, in the context that allows and admits) . The business and affairs of Cosmaka Grammar school are managed by the Chief Executive officer as the topmost custodian of the school. 2.5 Hours of work: Your hours of work shall be as specified in the application and appointment documents but you may be available for any additional hours of your choice if such hours are necessary for effective fulfillment of your professional duties. However, such additional time shall not be computed for purposes of additional payment.
2.6 Remuneration: You will receive each month the salary due to you for the full duties you have performed only. Salary shall be paid from the date of assumption of full duties up to and including the last day of performance of full duties. The employer may deduct from the salary any money owed by you to the employer.

2.7 Holidays: No salary shall be paid to you during, or for the time covering the holiday periods. You will not be expected to do school work during these closure periods. 2.8. Sickness or Injury: If you are absent from work by reason of sickness or injury, you must notify the employer as soon as possible on the first day of your absence and keep the Employer regularly informed of the situation and the likely duration
of the absence until you return.
(i) The absentee sick teacher will be paid up to one month of absence but the affected person may ask the employer to extend to two months or three, depending on the gravity of the sickness. The employer is not obligated to extend this period.
2.9. Termination of employment: Either the employer or you, the employee may terminate the employment by notice in writing of two months.
(i) The employer may, among other reasons, terminate the employment, due to violation of one or more of the terms of the agreement, inadequacy of teaching, misconduct by the employee, neglect of duty, physical or mental incapacity, conduct tending to reflect discredit upon the school; and or inadequacy of funds to pay the staff.
(ii) The Employer may at his discretion at any time including during any period of
notice given by either party amend your duties and/or suspend you from the
performance of your duties and/or exclude you from any premises of the Employer
and/or the Employer’s clients premises and/or require you to work from home.

(iii) The Employer reserves the right to terminate your employment without notice in circumstances of, in his view, gross misconduct.
(iv) A teacher whose employment is terminated before the end of his employment period shall be paid for only that time during which he has performed full duties. Such a teacher shall be paid up to the last day of service or employment indicated on the termination notice.
2.10 Grievance and disciplinary procedures: Grievances relating to your employment shall be first reported to your employer before any other outside considerations. All grievances will be treated as strictly confidential and will not be disclosed to others in the school unless you wish it. When the employer is unable to resolve the grievance, the aggrieved shall be advised to sick for external attention.
2.11 Right to hold Personal Data
As part of your conditions of employment, you give the Employer permission to
collect, retain and process information about you, such as age, sex, ethnic origin
and health records. This information will be used by the Employer for a number of
purposes, including but not limited to monitoring the Employer’s compliance with
the law and best practice. Should your personal circumstances change, you must notify the Employer immediately.

2.1 Estabishment: The establishment is Cosmaka Grammar school. Cosmaka Grammar school is a privately owned and managed institution. It is located at Kibalangulo in Mityana district. The proprietor of Cosmaka Grammar school is also the Chief executive Officer of this institution ( Which role shall extend to all his line successors, in the context that allows and admits) . The business and affairs of Cosmaka Grammar school are managed by the Chief Executive officer as the topmost custodian of the school. Consistent with this responsibility, all concerns expressed from any organs,staff, parents and other community members to the board members, teaching and non-teaching staff, shall be referred to the Chief Executive officer for review and action. 2.6 Remuneration: Membership on the Board of Cosmaka Junior School is fully voluntary. No salary shall be earned for serving on the Board of Cosmaka Grammar School. Members shall be given sitting allowance only. Sitting allowance shall be meant to cater for the food and transport allowance.Transport component shall be Commensurate with the amount of money used by that member in transport expenses from his known home to the institution by public means.

2.7 Board meetings: The Board shall sit once a year or for additional emergency meetings (extraordinary meetings). The Board of Governors can always seat if the majority of the members are present.
2.8 Technical matters: If there is any matter requiring professional and technical knowledge, it will be decided by relevant technical and professional people. The Chief Executive Officer will therefore from time to time invite such people into the Board meeting

2.9 Confidentiality: Both during the period of your service and thereafter, you shall not
disclose to any person or make use of, for your own benefit or for the benefit
of any other person, any trade secret or confidential information of the
school unless you have obtained the written consent of the Chief Executive Officer or
such use or disclosure is required for the proper performance of your duties as governor.

2.10 Termination of service: Either the Chief Executive Officer of the school or you, the governor may terminate the service by notice in writing

(i) The Chief Executive officer may, among other reasons, terminate the services, due to violation of one or more of the terms of the agreement, misconduct by the governor, physical or mental incapacity and any conduct tending to reflect discredit upon the school.

QN  WHO ARE YOU?

My name is Kasimba Mathias,the chairman “KYAMUSISI NKRUMAH UNIT VETERAN FOR SECURITY AND MOBILIZATION”.I was originally called Gashumba but because of the fear instilled in the Banyarwanda community by Milton Obote from 1966 to 1985 my mother changed it to Kasimba to evade the Obote hatred.By 1966 I was about 18 years having been born in 1948 and I heard many things unfold.Although I have not been able to improve my economic conditions, I am proud of my contribution to the stability and eventual progress of this country.

QN TELL ME ABOUT YOUR POLITICAL LIFE ?

When the bush war started in 1981 we immediately formed ourselves into war mobilization zones(units).I became the Butebe unit chairman responsible for Butebe,Kyamagemule,Kalama,Kalangaalo,Kyamanyori and the surrounding areas.The other units were Magara, headed by Nyanzi Yonathani,Kyamusisi,headed by Ssebunya Yowana,Kimuli,headed by Nsereko Alosius,Nakawere,headed by Ndekezi Livingstone,Mayobyo,headed by Kirembwe Erusama,Basajjamula,headed by Yokana Ssegane Musisi and Nyanzi headed by Nzaramba Augustine.

THE 1983 CHANGE OF TACTICS

The Nkurumah unit which was the over all supervisor in Mubende district changed tactics and phased out these units in 1983.Nkrumah unit was first headed by Afande Kanyankore and later Afande Gihanda.On the 9th Aug,1983,I joined the rebel ranks as a soldier.I was later made political commissar.

QN  ANY MEMORIES?

Many times,lorry fulls of Obote soldiers came looking for me.They would come chanting”leo ni leo.tunataka Kasimba etc” but God gave me the opportunity to live on.I survived about ten times.Many of the unit chairmen and other mobilizers were killed; Mulwana George and his brother Ndiwalana Jenelio were killed by Pilato (Walakira) and Kuku.Brave fighters and mobilizers like Nzalamba Augustine,Kabiligi Damaseni,Mpanga,Katende,Yokana Musisi Ssegane,Ndekezi Livingstone and others were all killed A bounty of 5000,000= was put on my head by Obote government but God protected me.I fell sick for five months( and I was hidden by one Aida Kibarawo,a munyankore woman, for four months).My mother tried to escape to Musaba but Warakila`s men tried to reach out to her. She flew to Toro settlement where she died from.When I get out of this poverty I will go for the body of my mother and rebury it.

QN    WHICH SOLDIERS MAINLY THREATENED YOUR OPERATIONS ?

We had Kakwanga,Bukulu,Mapengu and others. Some UPC youth wingers like Kayinja,Walakira,Katta and Damulira were a real threat.We tried to deal with them but made some mistakes. I issued a letter to one Kasirivu to reform but he refused.We consequently launched an operation on Kalangaalo on Easter 1983 with casualities.We were able to destroy the army hideout and store.Walakira(Pilato) later paid for his mistakes.

QN     ANY OTHER ASSIGNMENT?

On 5th Aug,1985,I was asked to leave the bush and carry out the following functions in Mityana area;(a) to recruit new forces (b)to supervise election of RCs,(c)to coordinate reconciliation committees and (d) to explain the aims of the war. This mission was accomplished in November,1985 and I rejoined to capture Kampala.

QN  ANY REGRETS?

I want to meet General Saleh and explain to him that the money sent by the President is channeled through wrong hands. The process should not ignore the traditional unit heads or the family members of those units. The families are known by us but sometimes we are sidelined.

QN   WHAT DROVE YOU AS AN INDIVIDUAL INTO THE WAR ?

You know I am a muyarwanda by tribe.Obote started mistreating us way back in 1966.The situation had been worsened by the presence of Umwami Kigeri who came in 1959.Obote asked him to leave Uganda within 48 hours in 1966.What followed his departure was the persecution of all Banyarwanda in Uganda. Amini brought him back in 1972 but was chased again by Obote in 1981.All Banyarwanda were not allowed to vote in 1980 election which was later declared rigged. In late 1982 all Banyarwanda were asked to leave Uganda and the memories are bitter.

WHY EAST AFRICAN STATES SHOULD EMBRACE BIRTHRIGHT CITIZENSHIP “JUSSOLIS”

All states in East Africa and Africa as a whole grant “citizenship by birth” based upon the principle of jus sanguinis (right of blood), in which citizenship is inherited through parents not by birthplace, or a restricted version of jus soli in which citizenship by birthplace is not automatic for the children of certain immigrants. Countries that have acceded to the 1961 Convention on the Reduction of Statelessness will grant nationality to otherwise stateless persons who were born on their territory, or on a ship or plane flagged by that country(Wikipedia). In Africa,an individual belongs to a family, a lineage, a clan and or a tribe; not a territory or a country. In this system, persons acquire citizenship through their parents or ancestors. BABUKUSU/BUKUSU:

The Bukusu live both in Uganda and Kenya.The Bukusu of Kenya believe that the descendants of Mwambu,their ancestor first settled at Masaba from Mumbo the creation place of Mwambu. The Babukusu are believed to have migrated from the Bamasaaba, particularly from areas around Bubulo, in the current Manafwa District. Many clans among the Babukusu have their origins among the Bamasaaba.During the Constituent Assembly that led to the 1995 Cosntitution of Uganda, Mulongo Simon, a delegate from Bubulo East, introduced Babukusu as one of the ethnic groups, acknowledging the fact that both groups, Bamasaaba and Babukusu are intertwined.

BAKIGA:

It is common knowledge that the Bakiga-Nyabingi belief is felt all over Kigezi ,Ruhengeri,and Byumba.While Kigezi is in Uganda,Byumba and Ruhengeri are in Rwanda.Queen Nyabingi who was born in Karagwe,grew up in Kigezi and died from Rwanda where it is believed his father lived.

SAMIA:

According to the Daily monitor of Thursday, March 21 2013, Every beginning of the year, the Samia of Uganda and of Kenya come together to celebrate their oneness. Even though they are separated by a border, they have found a way to keep their ties.Each year,they join hands to hold this day of cultural celebration at the beginning of the year. The festival takes the form of cultural expression in art,music, sport and dance. It brings out the young and old charging in an atmosphere of utmost gaiety. In another world, there would be no Uganda. There would be no Kenya either. Maybe then, the Samia people would not stand on one side of the fence,unable to cross over and say hello to a brother, sister or in-law on the other side,without a government hand rising to grant permission.

BANYARWANDA/BARUNDI/BAFUMBIRA/BASONGORA/BANYARUSHURU/BANYABWISHA/BANYAMULENGE/BAHORORO/.

The best way through which you can tell their oneness irrespective of the prevailing tag is through their clan and lineage system.In most cases the clan will be associated their cultural ancestor,Gihanga or to some extent Kigwa.The Most central clans are Bagesera,Abachaba,Abega,Abasindi,Abakono ,Abanyakarama,Abahondo,Abasinga among others.Their central mythical cultural ancestor wherever they Kigwa and his descendant Gihanga,Kanyarwanda and Kanyaburundi.Sometimes Gatwa,Gahutu and Gatutsi(not promoted these days for unity concerns).They can be collectively be referred to as abavandimwe(children of the same cord) because they all descent from Kigwa.Abavandimwe although in Rwanda and Burundi on the main,they are also in Uganda,Karagwe-Tanzania and Congo.There are always serious citizenship problems outside Rwanda and Burundi drawing humiliating and embarrassing scenes of verification to these groups.As a consequence some new tags have been used to avoid hostility such as Banyarushu,Banyabwisha,Bafumbira among others.

BAKONJO:

The Bakonzo and Banande descendants of Baiyra also have a hybrid nature of identity.They live both in Uganda and Congo in an area commonly known as Rwenzori homeland.According to the Journal of East African Studies: Banande and Bakonzo in the twentieth century,the the colonial boundaries between the British Protectorate of Uganda and the Belgian Congo divided the Banande from the Bakonzo.The Rwenzori abaruzi state that the Bakonzo are more in Congo except that in Congo they are known as Banande. Here below is a survey of some of the citizenship laws of East African states;

UGANDA;BIRTH (a) every person born in Uganda one of whose parents or grandparents is or was a member of any of the indigenous communities existing and residing within the borders of Uganda as at the first day of February, 1926 and set out in the Third Schedule to this Constitution; and (b) every person born in or outside Uganda one of whose parents or grandparents was at the time of birth of that person a citizen of Uganda by birth. PROBLEMS ASSOCIATED WITH STATELESSNESS IN THE WORLD AND EAST AFRICA IN PARTICULAR

The 1961 convention on reduction of stateless persons observed that about 12 million people are stateless.It further observed that most of them live in the shadows, with little or no access to education, health care, social services, or employment. Many are unable to move freely because of lack of identity documents.That they are always vulnerable to exploitation and human trafficking. Someone without a nationality cannot live the same life as someone with a nationality the UN observed.That if you want to understand the pain,try getting an ID without a nationality or try opening a bank account without an ID or try to board a flight without a passport .Some people who are not conscious of their legal status end up having their pride and dignity shattered.

CITIZESHIP TRENDS INUGANDA

According to the  “citizenship laws of the world-country listings”  Citizenship of Uganda is based upon the Constitution of Uganda.  Every person who was a citizen of Uganda on or before October 9, 1962, the date of independence, is considered a citizen of Uganda. And  or a Person born in Uganda after October 9, 1962, at least one of whose parents or grandparents is a citizen of Uganda or a Person born abroad after October 9, 1962, whose father was a citizen of Uganda is also a citizen of Uganda(UKC-Commonwealth Nation). The principle asserts that birth in a country automatically confers citizenship regardless of the parent`s citizenship or status.Citizenship by descent  is passed on to a child based upon at least one of the parents being a citizen of that nation,regardless of the child`s actual country of birth according to the principle of jus sanguinis.The 1995 defines citizenship by birth as (a) every person born in Uganda one of whose parents or grandparents is or was a member of any of the indigenous communities existing and residing within the borders of Uganda as at the first day of February, 1926 and set out in the Third Schedule to this Constitution; and   (b) every person born in or outside Uganda one of whose parents or grandparents was at the time of birth of that person a citizen of Uganda by birth. The principle of jus solis in this case does not apply. The options for those left out is either to agitate for adherence to the principle of jus solis or to apply for either naturalization or registration subject to conditions. The process might be lengthy but good things come the hard way. One may need to fill forms making some declarations. He/she may need a legal officer for some stamps.He/she may need secondment from senior citizens and he/she may need letters of good behavior from police

KASANVU In Uganda historyseries

ASIAN FARMERS

The economic trends in Uganda changed following the arrival of Aga Khan in 1905.It marked the beginning of the immigration of Asian farmers to Uganda.They established large plantations of sugar and tea.The colonial government had also facilitated the growth of cotton and coffee as a source of income to the indigenous people.Part of the income would be used to pay tax.

LOCATION OF PLANTATIONS

Mehta and Madhvan families established large estates of sugar which included Lugazi/Kawolo,Kakira and Kinyara. Toro and Mityana tea company (Tamteco) and Uganda tea growers`corporation established large scale tea estates in several parts of the country.

LABOUR IMPLICATIONS

The indigenous people refused to offer voluntary paid labour as they looked down the practice of labouring(obupakasi).The colonial office looked elsewhere for labour supply.Treks of labourers started arriving from Rwanda,Burundi,Karagwe and Kigezi.Others came from Sudan,West Nile and Congo.

FORCED PAID LABOUR (KASANVU)

The arriving migrant workers were required to work on sugar or tea plantations for seven months before they would become free.Those who completed the seven months compulsory period would then be free or Malayaz as they preferred to call them.The malayaz would then be free to either continue working on the plantations or elsewhere on the cotton and coffee plantations privately owned by local chiefs.Previously,the practice of Kasanvu existed in central Uganda but had been stopped around 1922. According to the Daily Monitor of Thursday, May 24 2012, the colonial administration, under pressure from the Colonial Office in London, abolished the Kasanvu system between 1922 and 1923. which meant that by the time Mehta set up his sugar factory at Lugazi in 1924, there was a shortage of labour to work on the sugarcane plantation. According to June Starr and Jane Fishburne,Kasanvu required that every able bodied man work on public projects unpaid for one month a year.There was another type of forced labour called Luwalo. Luwalo required the same able bodied man to work for one month a year on any of the local chief`s private project.Kasanvu had to be revived only in new style (forced but paid and to non indignant workers )

CONDITIONS OF WORK DURING KASANVU

Those serving kasanvu were not supposed to travel.They were required to sleep in one group in one hall.Any attempt to escape would be met with death.A dead person would be buried by a group from another house.The sick was treated alone,no care taking.Very few survived sickness.It is told by survivors that out of the twenty seven (the required number for each group) about ten managed to complete kasanvu alive.The rest would die of sickness.

SETTLEMENT

Those who completed kasanvu were retained as free workers.Others were allowed to integrate into the local communities and either bought land and became settlers or became labourers (abapakasi).It is common knowledge that there are large settlements of assimilated communities from as far as Rwanda,Burundi,Tanzania,Congo and Sudan in areas that neighbor the tea,sugar and coffee growing areas.

CITIZENSHIP

The Uganda Independence Act of 1962  resolved the matter as follows;
”(3) Subject to subsection (8) of this section, a person shall not cease
to be a citizen of the United Kingdom
and Colonies under the last preceding
subsection if he, his father or his father’s father—
(a)
was born in the United Kingdom or in a colony; or
(b)
is or was a person naturalised in the United Kingdom and
Colonies; or
(c)
was registered as a citizen of
the United Kingdom and Colonies;
or
(d)
became a British subject by reason of the annexation of any
territory included in a colony.
(4) A person shall not cease to be a citizen of the United Kingdom
and Colonies under subsection (2) of this section if he was born in a
protectorate or protected state, or if hi
s father or his father’s father was so
born and is or at any time was a British subject.”
However,citizenship tempers have been boiling over years about former migrant workers,their children or grand children.According to Cultural Survival advocates for Indigenous Peoples rights inc, Ugandan leader Milton Obote ordered the registration of all peoples of Rwandan origin in 1969.The takeover of Idi Amin provided a temporary relief. According to cultural advocates the registration data was used to deny the Banyarwanda voting rights in 1980.In late 1982,officials of the government orchestrated a large scale displacement of Banyarwanda. Affected were those who had always lived in Uganda as well as refugees who had arrived in the sixties citizens and non-citizens alike. Beginning on October 1, teams of local officials, members of the youth wing of the
UPC, and special forces of the police attacked Banyarwanda homes. These were
destroyed or rendered uninhabitable as the mud walls were pushed in or the
corrugated metal roofs were stolen. Even homes on the perimeter of long-established refugee settlements were destroyed. Intimidation of the people, accompanied by beatings and a number of killings,precipitated large-scale displacement. By October 2, Banyarwanda were streaming from
their homesites, some into the established refugee settlements and some across the boarder into Rwanda. Although allowed to take what possessions they could carry, most were taken from them at the numerous roadblocks manned by members of the Special Police Force and the UPC youth wing. Local inhabitants were prevented by the eviction teams from giving or selling water, food or shelter to those in flight. Most entered Rwanda on foot. Caught unprepared, Rwanda officials arranged for trucks to transport the refugees to camps. Those who fled to the established refugee
settlements within Uganda waited in fear of the governments next actions. By

There are arrangements by East African leaders to solve the citizenship question once and for all. Data centers and registration bureaus have been established following the successful biometric registration of all persons in the respective East African countries.

Oral Literature in Uganda;the NYABINGI Legend in Kigeziregion

One of the most influential imandwa(heroic spirits of the dead) in Kigezi region is Nyabingi.Nyabingi has been and is believed and worshiped by many followers mainly in Rukiga,Ndorwa,Mpororo,Ruhengeri,Byumba and Karagwe.According to Aman Athar,a researcher in Rwanda,Nyabingi is worshipped through her intermediaries or priests and priestess called “ Abagirwa”.Abagirwa perfom rituals in a ceremony called Kubandwa.The most important Nyabingi sites in Uganda are at the caves of Nyakisenyi in Kigezi region.A legendary woman known as Muhumusa in Kigezi and Muhumuza in Rwanda has kept the Nyabingi spirit burning in Western Uganda.Allegedly possessed by Nyabingi spirit Muhumuza and her worshipers rose against the white colonialists destroying their buildings and other symbols of authority.This rebellion although not well promoted by Ugandan historians came to be known as THE NYABINGI MOVEMENT.Muhumusa was captured by the British in 1913 and detained in Kampala until her death in 1945.Many ill and barren villagers believed that Nyabingi who was also considered the rain maker,would cure their diseases and infertility if they made good sacrifices to her.On that note Nyabingi spirit is believed to have possessed some Bakiga/Banyarwanda mediums and blessed them with power to heal,make rain and cure infertility. Nyabingi`s parentage is a subject of discussion with some suggesting that she was born to a Muhaya in Gahaya house and her primary name was Kanzanire while others know her as daughter of Bwinshi hence the name Nyabwinshi or Nyabingi as widely pronounced.Bwinshi`s name is believed to have been used to hide a fact according to Amani Athar.Her true father was Ruganzu who later became king and ruled as Ruganzu Ndoli.Nyabingi was born in Karagwe,now Tanzania and grew up in Ndorwa,now Uganda.When her father Ruganzu became king she was blessed and rewarded among others with a title of Princess and that is how she came to be known as a very important goddess in the region.Muhumusa or Muhumuza her chief priest is believed by legends in Rwanda to have came to Kigezi to look for a drum makiga previously owned by a dead mukiga elder.This drum was believed to be a source of riches.This expedition set her on a collision course with colonialists leading to a war that ended in her capture.Alleged possessions of Nyabingi continue up to today especially among women in non Christian families in the region.There are versions that present Queen Muhumusa as a power hungry woman rather than a freedom fighter. According to Andrew Cornwall,Readings in Gender in Africa,Muhumusa who claimed to be the wife of Rwabugiri became disgruntled when her son`s attempt to succeed his father as king was challenged by war.She fled to the north and gathered supporters while personalizing Nyabingi,and tried to install her son as King but the Germans doomed her chances with the support of Musinga,the then reigning king.She was annoyed and turned her anger against the Europeans.With a large following of Bakiga and Banyarwanda,she raided their stations and destroyed buildings and declared herself the Liberator and Queen of Ndorwa.She was later captured and detained until her death.

EAST AFRICAN ORAL TRADITIONS ; ABACHWEZI , ABAHINDA AND ABEGA SINGLE FAMILYMYTHOLOGY

ABACHWEZI
Ndahura is given as the first Muchwezi.He was the son of Isimbwa.Isimbwa was the son of Isaza.Interestingly ,Isaza was the last king of Abatembuzi. Isaza was the son of Ngonzaki ,Ngonzaki was the son of Bada and Bada was the son of Kakama.Kakama on his part was the son of Nkya.Ruhanga was the first king on earth and he was a mutembuzi.Ndahura`s son Wamara was also the last chwezi king .
ABAHINDA
The Bahinda clans can be found in Uganda,Tanzania,Rwanda and Burundi.While they are ordinary clans in Rwanda and Burundi,they are given as kingdom founders in Uganda (Ankore) and Tanzania (Karagwe).Ruhinda,the founding father of Abahinda clan in Uganda is said to have been the son of Wamara and  wife Njunaki of Bunyoro Kitara.Ruhinda Kizirabagabe I of Karagwe is said to have been related to Ruhinda Njunaki of Ankore.It is not clear whether there was any relationship beween Chief Ruhinda of Ruhaga in Buha and the two Ruhindas earlier discussed.
ABEGA
“Nkuko twabibonye ku Basindi cyangwa ku Banyiginya, Abega bakuru benshi twabajije nabo batubwiraga ko inkomoko zabo za mbere ziherereye mu nce zo mu majyaruguru y’u-Rwanda kimwe no mu majyepfo ya Uganda y’ubu, muri za Ndorwa-Ankole-Kigezi-Rukiga, ndetse mbere na mbere bikaba bishoboka ko baba baravuye mu majyaruguru kurushaho, ahagana muri za Bunyoro-Butoro.”
Translated: As seen about the Basindi or the Banyiginya,the Abega we spoke to told us that they originate from the north of Rwanda and the south of Uganda of today in the areas of Ndowa-Ankore-Kigezi-Rukiga,but it had been known earlier that they came from the north in Bunyoro-Butoro.
“Icyiciro cya kabiri ni icyaciye muri za Nkore gikomeza kigana za Karagwe na Buhaya, bakamanuka bagana mu Bushubi, Bushingo, Buha kuzagera mu Burundi. Paraphrased: The second group came through Ankore ,Karagwe,Buhaya, they went down to Bushubi,Bushingo,Buha up to Burundi…these entered Rwanda from Buhaya and Karagwe.

KANYARWANDA,KANYABURUNDI AND GIHANGA : The East African myths oforigin

Once upon a time, there lived a man called Kanyarwanda and another called Kanyaburundi.The two were brothers and sons of Gihanga.Gihanga was the son of Kazi ka Muntu who was  a great grand son of kings from heaven(Ibimanuka).Kanyarwanda founded his kingdom called Urwanda while his brother Kanyaburundi founded another called Uburundi. Does it logically follow that Kanyarwanda is the ancestor of all the Banyarwanda and Kanyaburundi  the ancestor of all the Barundi ? The Banyarwanda and Barundi are the peoples of Rwanda and Burundi on the main, and to an extent Uganda,Congo and Tanzania. The  2014 Percentage distribution of  population by ethnicity  in Uganda placed the Uganda Banyarwanda citizens at 524098 of whom 252493 were males while 271605 were females. 422355 lived in rural areas while 101,743 lived in towns.The report also placed  Barundi-Uganda citizens at 92570 of who 48657 were males while 43913 were females. 82134 of these lived in rural areas and 10436 lived in urban areas. It was also observed that  there were 91231 Banyarwanda  and 21798 Barundi residents in Uganda at the time of the 2014 census report. A resident might be required to take a slightly further step to become a citizen. Of the 91231 Banyarwanda residents,43271  were males while 47960 were females. 66058 resided in villages while 25173 resided in towns.Of the 21798 Barundi residents, 11,198 were males while 10600 were females.19322 lived in villages while 2476 lived in urban areas.  ( Main report; National Population and Housing census, 2014)
