But like in the ancient world they still relied on the power of the wind and used sails. Implementation of the Nigerian Local Content Act of 2010Nigeria is blessed with abundant mineral resources, especially oil and gas. Oil was first found in Nigeria in 1956 at Olobiri in the present-day Bayelsa State.This oil and gas sector is presently being harnessed at onshore and offshore with concentration in the Niger Delta Region. Nigeria is also blessed with a reasonable coastline and a network of inland waterways that empty into the Atlantic Ocean for maritime activities. Maritime and oil/gas activities are interrelated and interwoven.The maritime and oil/gas sectors have over the years been dominated by foreigners. The Federal Government, through the National Assembly to ensure that Nigerians participate fully in these sectors and become major players/actors, enacted the Nigerian Cabotage Act of 2003 for maritime activities and the Nigerian Local Content Act of 2010 for oil and gas activities. These two acts would bring about a multiplier effect on all sectors of the economy.The Nigerian Cabotage Act was enacted out of the need to improve indigenous participation in maritime activities, and increase local capacity building. The oil and gas sector plays a predominant role in Nigeria's sea trade, as it contributes about 95 per cent to coastal and inland shipping and allied maritime activities. The low level of participation by Nigerians in the coastal trade had a negative impact on both human and infrastructures capacities of the country to effectively take advantage of her domestic maritime trade to advance our economic development. The Act covers all marine transportation from one place in Nigeria or above Nigerian waters to any other place in Nigeria, and includes transportation in relation to the exploration, exploitation, or transportation of mineral resources in Nigeria.The Nigerian Local Content Act of 2010 is to protect and indigenise the nation's fledging oil and gas sector, as majority of oil and gas exploration companies operating in Nigeria are foreign. This Act is specifically tailored to improve the lots of Nigerians in the oil and gas sector. It also advocates that more Nigerians should get more involved in the oil and gas business, as the act encourages indigenous participation and local capacity building.Oil and gas companies already operating in Nigeria must comply with the Act, for non-compliance would lead to shutdown of operations, fines and outright closure in extreme cases.With the Act in place, there will be job creation, transfer of technology and expertise, engineering and fabrication technology development, engagement of indigenous-owned vessels and equipment, local capacity building and improved income per capital.The Nigerian Local Content Act provides that any investment in the oil and gas sector must comply in the areas of employment generation, expatriate quota, as well as provision of facilities. These investments are the exploration, exploitation and drilling activities. Other investments include provision of mobile drilling rigs, production platforms, and facilities supply vessels, and various barges for pipe-laying, launching structures and other works. Others include jack-up rig and drill ships for drilling operations, anchor handling tugs, floating petroleum storage and offloading systems.Nigerians also are to participate in the lifting of the nation's crude oil and gas, and the carriage inward and coastal trading of refined petroleum products. They would also be engaged in the various segments of marine transportation in the oil and gas sectors.With the Nigerian Local Content Act in place, the Indigenous Ship Owners Association of Nigeria (ISAN) would play a very dominant role in the nation's maritime, and oil and gas sectors. The Nigerian National Petroleum Corporation (NNPC), the Department of Petroleum Resources (DPR), and the Nigerian Maritime Administration and Safety Agency (NIMASA), the regulatory agencies involved should ensure the Nigerian Local Content Act is implemented. They should start working out modalities and framework to ensure this Federal Government Act on local content is realised.The regulatory bodies and the Nigerian Local Content Development and Monitoring Board (NCDMB) should organise workshops and seminars on the implementation of the local content policy for all stakeholders in the maritime, and oil and gas sectors.
